[Newspapers.com files the Rochester Union and Advertiser of 1907 under its later title. The Democrat and Chronicle of 13 Aug 1907, p. 12 (image 135453375), has a shorter report headed "[Ca]uses Damage Suit. [Ow]ner Alleges Contributory Negligence." Which Jacob Hegnauer was the plaintiff is not stated; in 1907 the Jacob of the family was Jacob Rudolph (H0534), aged 48, his father having died in 1899.]

BICYCLIST TO BLAME SAYS CHAUFFEUR

Contributary Negligence Alleged in Action For Damages.

Contributory negligence is the defense set up in behalf of George S. Seigel, who has been named as defendant in an action for damages instituted by Jacob Hegnauer, summons and complaint in which have been served upon James L. Whitley, counsel for the defendant.

An automobile accident is the basis for the action, it being alleged that the plaintiff was run down by the defendant while the latter was operating his motor car in Scio street on June 16th last.

Hegnauer was riding his bicycle along the street at the time he was run down and claims that he had no warning of the automobile's approach and as a result suffered injuries for which he thinks $3,000 would be adequate compensation.

In the answer to the complaint it is set forth that the plaintiff was riding on the wrong side of the road and the motor car was moving slowly and under perfect control, and that the mishap to the plaintiff was due to his own carelessness.

The action is listed for trial early in the term of Supreme Court which opens in September. Arnold L. Empey appears for the plaintiff.
